Acceptance of Terms
By accessing, installing, or using any service within the Nxus digital mobility ecosystem, you agree to be legally bound by these Terms of Service. If you disagree with any provision herein, you must cease use of our digital platforms immediately.
Description of Service
Nxus is an advanced mobility technology platform that algorithmically coordinates prearranged For-Hire Vehicle (FHV) dispatch between prospective riders and independent TLC-licensed drivers. Nxus operates in strict accordance with NYC Taxi & Limousine Commission regulations.
Rider Operating Terms
- Riders must be at least 18 years of age to initiate or authorize a trip account.
- Accurate spatial pickup and drop-off coordinates must be provided prior to dispatch.
- Riders agree to conduct themselves respectfully and adhere to all safety protocols.
- The upfront fare is calculated and locked prior to trip confirmation.
- All settlements occur digitally within the encrypted application checkout pipeline.
Driver Operating Terms & 90/10 Model
- Active TLC driver license, commercial FHV insurance, and vehicle registration required.
- Drivers operate as autonomous independent contractors with complete schedule sovereignty.
- Under the Nxus model, drivers are targeted to retain 90% of passenger trip fares, excluding statutory taxes.
- Nxus provides no earnings guarantees, volume quotas, or predetermined income promises.
- Strict adherence to city vehicle safety, accessibility policies, and TLC mandates is mandatory.
No Street Hails Policy
Nxus operates exclusively as a prearranged FHV dispatch platform. Physical street hails, curbside flag-downs, and unscheduled solicitations are strictly prohibited by NYC TLC law. All dispatches must originate algorithmically via the secure Nxus app.
Mutual Safety & Community Guidelines
Safety is an uncompromising requirement. Both riders and drivers are held to strict standards of vehicle operation, zero alcohol or drug tolerance, and non-discriminatory service. Nxus reserves unilateral authority to immediately revoke access for safety violations.
Limitation of Liability
Nxus provides algorithmic matching and communications software; it is not a transportation carrier or motor fleet operator. To the fullest extent permissible by applicable law, Nxus shall not be liable for indirect, incidental, or consequential damages resulting from platform usage.
Platform Terms Modifications
Nxus reserves the right to revise or update these terms in accordance with evolving municipal statutes or technological deployments. Users will be notified of material modifications through the application interface prior to new terms taking effect.
